Terms of service
Effective date: 22 August 2026
These Terms of Service govern the use of emansgallery.com and purchases made from Eman Khalifa under the professional identity Eman Khalifa | Contemporary Artist.
1. Application and Acceptance
These Terms apply to:
- visitors to emansgallery.com;
- online purchases made through emansgallery.com;
- purchases made directly from Eman Khalifa in person; and
- purchases made through a third-party platform associated with emansgallery.com, except where the platform or a separate written agreement provides additional or different terms.
By using the website or making a purchase from Eman Khalifa, the customer confirms that they have read, understood and agree to these Terms and the policies incorporated into them.
These Terms should be read together with the applicable product information, checkout information, Returns & Refunds Policy, Shipping, Duties & Tax Policy and Privacy Policy.
Where a product page, commission agreement, quotation or third-party platform contains specific terms applicable to a purchase, those specific terms will take priority over these general Terms to the extent of any direct inconsistency.
A customer making a purchase must be at least 18 years old or otherwise have the legal capacity and authority required to make the purchase.
2. Website and Store Operator
The website and store are operated by Eman Khalifa under the professional identity Eman Khalifa | Contemporary Artist.
The online store is hosted through Shopify, which provides the ecommerce platform used to display products, process orders and facilitate payments.
References to “Eman Khalifa”, “we”, “us” or “our” in these Terms mean Eman Khalifa | Contemporary Artist.
3. Products and Fulfilment
Products are fulfilled in the following ways.
Products Dispatched From Eman Khalifa’s Studio
These include:
- original artworks;
- A4 mounted prints;
- A6 prints; and
- any other product stated to be dispatched from Eman Khalifa’s studio.
Products Fulfilled Through Printful
These include:
- canvas prints;
- framed paper prints; and
- merchandise.
Printful products are produced on demand and may be fulfilled from different locations according to the product and delivery destination.
Commissioned and Custom-Made Products
Commissioned, personalised and custom-made products are produced according to an agreed written brief, quotation or product specification.
4. Product Information and Artwork Characteristics
Eman Khalifa takes reasonable care to present product descriptions, materials, dimensions, photographs and prices accurately.
Customers should review all product information and select the required format or variant before completing payment.
Colours may appear differently depending on screen settings, lighting and photography. Metallic, reflective, textured or layered surfaces may also change in appearance according to the viewing angle and surrounding light.
Room mock-ups and lifestyle images are illustrative. Customers should rely upon the measurements stated on the product page when assessing the physical scale of a product.
Original artworks may contain intentional brushwork, texture, pouring patterns, surface variation, visible edges and other characteristics arising from the artistic process. These form part of the individual artwork and are not manufacturing defects.
Original artworks are one-of-a-kind unless expressly stated otherwise. Purchasing an original artwork does not guarantee any future financial, investment or resale value.
5. Ordering and Purchase Process
For online purchases, the customer normally:
- selects the required product and format;
- adds the product to the cart;
- reviews the cart and quantities;
- proceeds to checkout;
- supplies the requested billing and delivery information;
- reviews the product price, shipping charge and total payable amount; and
- submits payment.
The customer can review and correct the order before submitting payment.
An order is accepted when payment has been accepted and an order confirmation has been issued, subject to product availability and verification.
Eman Khalifa may reject or cancel an order where:
- payment has not been authorised;
- the product is unavailable or has already been sold;
- the customer’s information is materially incomplete or inaccurate;
- delivery is unavailable to the supplied destination;
- a material pricing or product-information error has occurred;
- the order appears fraudulent or unlawful; or
- fulfilling the order would breach an applicable legal or platform requirement.
If Eman Khalifa cancels an order after receiving payment, amounts paid for the cancelled product will be refunded using the original payment method where practicable.
Because original artworks may also be offered in person or through third-party platforms, an artwork may occasionally sell through another channel before online availability has updated. In that event, the online order will be cancelled and the amount paid will be refunded.
6. Prices, Payment and Discounts
Product prices are displayed in the currency selected or made available through the website or third-party platform.
Shipping charges are calculated and displayed at checkout before the customer completes online payment.
Customs duties, import VAT, brokerage charges, local taxes and similar destination charges are not included unless checkout expressly states otherwise.
The customer is responsible for charges imposed by their bank, card provider or payment provider, including currency-conversion or international transaction charges.
Available discounts are applied according to their stated conditions. Discount codes cannot be exchanged for cash and may not be combined unless expressly permitted.
Product prices and promotions may change before payment is completed. A later price change will not alter the product price already accepted for a confirmed order.
Separate quotations or written terms may apply to commissions, wholesale orders, trade purchases and other individually negotiated arrangements.
7. Shipping, Delivery, Duties and Tax
Shipping charges, preparation periods, estimated delivery times, tracking, customs charges, unsuccessful delivery, delivery responsibility, outward-delivery claims and split shipments are governed by the Shipping, Duties & Tax Policy.
The customer is responsible for supplying complete and accurate delivery information and reviewing the applicable shipping charge before payment.
Delivery estimates are estimates rather than guaranteed arrival dates unless a guaranteed service has been expressly agreed.
8. Cancellations, Returns and Refunds
Cancellation requests, return authorisation, return-delivery requirements, condition assessments, deductions, refund calculations, commissioned products, in-person purchases and Printful returns are governed by the Returns & Refunds Policy.
A customer must not dispatch a return before receiving the applicable written return instructions from Eman Khalifa.
9. Printful-Fulfilled Products
Canvas prints, framed paper prints and merchandise are produced and fulfilled through Printful.
Production location, availability, delivery service and delivery timeframe may vary according to the product and destination. Products from the same order may be fulfilled separately.
Customers must contact Eman Khalifa at talk@emansgallery.com regarding a Printful order or return and must not independently send a product to Printful or to an address appearing on the parcel.
The applicable procedure for Printful cancellations, returns, delivery issues and refund calculations is set out in the Returns & Refunds Policy and Shipping, Duties & Tax Policy.
10. Commissions and Custom-Made Products
A commission or custom-made order may be subject to a separate written brief or quotation covering:
- dimensions;
- materials;
- composition;
- colours;
- price;
- payment stages;
- estimated completion time;
- delivery;
- revision opportunities; and
- any product-specific conditions.
Work will begin according to the payment and approval arrangements stated in the quotation or written agreement.
Changes requested after work begins may affect the price and completion date and must be agreed in writing.
Delays caused by missing customer information, approvals or requested changes may extend the estimated completion date.
Commissioned, personalised and custom-made products are subject to the cancellation and return restrictions stated in the Returns & Refunds Policy.
11. Gift Cards
Gift cards may be subject to additional conditions displayed when purchased or issued.
Gift cards may be used only through the purchasing channel for which they were issued unless Eman Khalifa confirms otherwise.
Gift cards cannot be exchanged for cash except where required by applicable law.
The customer is responsible for protecting any gift-card code supplied to them and should contact Eman Khalifa promptly if a code is believed to have been compromised.
12. Artwork Care, Installation and Certificates
Where a certificate of authenticity, frame, mount, accessory or care instruction is included, this will form part of the supplied product.
The customer is responsible for following any care, handling, framing or installation guidance supplied with the product.
Customers should use an appropriately qualified installer where the size, weight, value or location of an artwork requires professional installation.
Eman Khalifa is not responsible for damage caused after delivery by unsuitable handling, storage, cleaning, framing, mounting, installation, environmental conditions or alteration by the customer or another person.
Nothing in this section excludes responsibility that cannot legally be excluded.
13. Copyright and Intellectual Property
All copyright and intellectual-property rights in the artworks, designs, photographs, videos, text, branding and other content remain with Eman Khalifa or the identified rights owner.
The purchase of an original artwork, print or other product transfers ownership only of the physical product purchased. It does not transfer copyright, reproduction rights, commercial-use rights, licensing rights or digital rights.
Unless Eman Khalifa agrees otherwise in writing, customers must not:
- reproduce an artwork or image for commercial purposes;
- manufacture or sell copies or derivative products;
- use an artwork as a logo, brand identity or commercial design;
- mint or use an artwork as an NFT or other digital asset;
- use website or artwork content to train an artificial-intelligence system;
- remove or alter a signature, attribution or copyright notice; or
- claim authorship of an artwork or design.
Eman Khalifa retains the right to photograph, reproduce, exhibit, publish, license and sell prints or other authorised reproductions of an artwork, including after the original artwork has been sold, unless an exclusive written agreement states otherwise.
Reasonable personal photography and incidental inclusion of an artwork in non-commercial photographs are permitted.
14. Customer Reviews and Submitted Content
If a customer knowingly submits a review, testimonial, photograph or other content for publication, the customer confirms that:
- the content is accurate and lawful;
- they have permission to submit it;
- it does not infringe another person’s rights; and
- Eman Khalifa may display, reproduce and format it for website, portfolio, promotional and social-media purposes.
The customer retains ownership of their submitted content.
Eman Khalifa may decline or remove submitted content that is unlawful, misleading, abusive, irrelevant or infringes another person’s rights.
15. Acceptable Website Use
The website and its content must not be used:
- for an unlawful or fraudulent purpose;
- to infringe intellectual-property, privacy or other legal rights;
- to transmit malicious code;
- to interfere with website security or operation;
- to collect personal information without authority;
- to impersonate another person;
- to submit false or misleading information;
- to scrape, systematically copy or commercially exploit website content; or
- to harass, threaten or harm another person.
Access may be restricted or terminated where these conditions are breached.
16. Third-Party Services and Links
The website may use or link to third-party services, including Shopify, payment providers, Printful, couriers, social-media platforms and third-party sales platforms.
Those services may have their own terms and privacy practices. Customers should review the applicable third-party terms before using those services.
Eman Khalifa does not control the availability or content of unrelated third-party websites.
The involvement of a third-party service does not exclude any responsibility that Eman Khalifa cannot legally exclude.
17. Personal Information
The collection, use, storage and disclosure of personal information are governed by the Privacy Policy.
Customers must provide accurate information where it is reasonably required to process payment, fulfil an order, arrange delivery or respond to a request.
18. Website Availability and Errors
Eman Khalifa may update, suspend or discontinue website content, products, features or services.
Reasonable efforts are made to keep the website available and accurate, but uninterrupted or error-free access cannot be guaranteed.
Errors relating to product descriptions, availability, prices, promotions, shipping charges or other information may be corrected when discovered.
Where a material error affects an order, Eman Khalifa will contact the customer and, where appropriate, offer the option to proceed on the corrected basis or receive a refund for the affected product.
19. Liability and Consumer Rights
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of rights that cannot legally be excluded; or
- any other liability that applicable law does not permit to be excluded.
For consumer purchases, Eman Khalifa is responsible for losses that are a foreseeable result of a breach of these Terms or a failure to use reasonable care and skill.
Eman Khalifa is not responsible for losses that were not reasonably foreseeable when the purchase was made or that result from inaccurate information, misuse, unsuitable installation or failure to follow supplied instructions.
Products purchased by consumers are intended for private use unless otherwise agreed. Eman Khalifa is not responsible for business losses arising from a consumer purchase, including loss of profit, business interruption or loss of commercial opportunity.
Nothing in these Terms removes any mandatory consumer protection available under applicable law.
20. Circumstances Outside Reasonable Control
Eman Khalifa will not be responsible for delay or failure caused by circumstances outside reasonable control, including severe weather, fire, flood, transport disruption, customs delay, industrial action, public-health restrictions, internet or payment-network failure, supplier disruption or government action.
Where such circumstances affect an order, Eman Khalifa will take reasonable steps to communicate with the customer and reduce the effect of the disruption.
21. Changes to These Terms
These Terms may be updated to reflect changes to the website, products, fulfilment arrangements, business practices or applicable requirements.
The current version will be published on this page with its effective date.
Changes will not retrospectively alter a completed purchase unless the customer agrees or the change is required by law.
22. Severability and Waiver
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
A failure or delay in enforcing a provision does not waive the right to enforce it later.
23. Governing Law and Disputes
These Terms are governed by the laws of England and Wales.
Customers residing elsewhere retain any mandatory consumer protections that apply in their place of residence.
The courts of England and Wales will have jurisdiction, except where applicable consumer law allows the customer to bring proceedings in another jurisdiction.
Customers should first contact Eman Khalifa so that an attempt can be made to resolve any concern directly.
